Newspapers have made statements as: " In the weeks since the approval for the construction of I-69..."

Actually I-69 construction has not been approved.

The Federal Government requires environmental impact studies (EIS) for major projects using federal funds.

I-69 in Indiana thus requires such federal approval.

State DOTs have argued that these studies are such monumental tasks, that they should be able to break a single study into Tiers.  We have heard of proposals for even three tier  EIS, but we do not believe any have yet been approved.  Still two tier studies are becoming rather common, though they are still not preferred by the Federal Highway Administration.  Critic's claim this Tiering process leads to omission's as facts are put off until Tier 2 and then never done.  Effective and efficient lawsuits must wait until the second Tier is complete to prove negligence.

The point is, construction is not "approved" until the EIS is complete.  The I-69 (3C) from I-64 to I-465 has only been approved to continue into it's second Tier.*
